A card hold, a refund or a deduction? Start with the payment
Find the original transaction in your statement. A pre-authorisation reserves funds; a completed charge means money has been collected. A cash deposit or bank transfer needs to be checked against the receipt or transfer record. Keep these separate from any advance booking payment.
Wise explains that reversing a card hold and refunding a completed payment follow different processes and timelines. Ask your own bank to identify the transaction and check the release status. Payment-processing time does not give a rental company an unrestricted right to postpone returning money.
LuvDrive’s published terms state that deposits are returned by bank transfer within 15 minutes of vehicle return. Section 7 of Rentacar Phuket’s policy describes initiating a refund within seven business days, followed by payment-provider processing. These are examples of individual companies’ published policies, not a Phuket-wide legal deadline or an endorsement of every clause. What the current rules mean for your return
OCPB states that contract controls for car and motorcycle rentals took effect on Dec 30, 2025. Deposits should be returned in full where there is no damage; any balance after justified deductions must be returned within the legal timeframe.
A clause appearing in an agreement does not, by itself, settle whether a deduction is lawful. If you are given a blanket waiting period without an explanation of the payment type, or referred to terms you did not accept, ask for the basis and check the applicable rules with OCPB. Build a single evidence folder
Keep the agreement, booking confirmation, deposit receipt, return report and photographs from collection and return. Export messages while they remain available. Write a brief timeline: when you returned the car, what the employee said and when repayment was promised. Redact unrelated transactions and unnecessary account details before sharing a statement.
Request a final account
Ask the company to separate money received, amounts credited towards the rental, deductions and the balance to be returned. If a refund has been sent, request the date, amount, currency, recipient and transaction reference. If money is being retained, ask for the contractual basis and supporting records. This turns a vague dispute into questions that can be checked.
Check each disputed item
For damage, request photographs from before and after the rental, a description of the defect and an estimate or other itemised calculation. For missing fuel, compare collection and return readings. For late return, compare the agreed time with the actual handover of the keys. Do not sign a statement acknowledging a full refund if you have received only part of it.
Send a written request
Use the company’s official contact channel and retain proof of sending. Include your identity and agreement number, with the relevant records attached. Ask for a response by a specific, reasonable date; a response date you propose is not automatically a statutory refund deadline.

Use the appropriate support channel
If the company does not resolve the issue, use OCPB’s complaint form or call 1166. Ask your bank to check a card payment and explain whether it can be disputed; the process and deadlines depend on the payment method. A dispute does not guarantee recovery. If you face threats or need urgent assistance in person, contact the Tourist Police on 1155.
Why damage compensation is not necessarily rental profit
A car undergoing repair may be unavailable for rental. The operator must arrange assessment and repairs, wait for parts and sometimes pay for recovery or reorganise bookings. Compensation may cover only some of those costs. However, the company’s economic loss and the amount a particular renter is liable to pay are separate questions.
To check a downtime claim, request the period the vehicle was actually unavailable, the reason for its duration, the relevant agreement clause and an explanation of insurance payments. If lost income is claimed, consider whether the car could realistically have been rented and which costs were avoided. Multiplying repair days by the full daily rental rate does not, on its own, establish lost net profit.
This is an explanation of the economics, not blanket permission to charge renters for downtime. Liability depends on the circumstances, valid contract provisions and insurance terms. The same loss should not be counted again as a repair already paid for, an insurance recovery and an additional unexplained charge.

Who receives your payment, and which legal entity is named in the agreement?

Before paying, ask the operator to explain an example final account for an undamaged return and for a return with one disputed defect. A clear explanation is more useful than a general promise that everything is included.
